The Law Offices of William D. Ross (LOWDR) is a full-service law firm with extensive experience in representing local governments, developers, and private and commercial land owners. The Firm’s broad range of services include representing clients in matters ranging from land use, regulatory compliance, environmental review, local government administration, real estate development, and applications to the Local Agency Formation Commission.

Founded in 1984, LOWDR has tailored its legal practice towards serving the varying and diverse needs of cities, special districts, and property owners. With a main office in Palo Alto and a satellite office in Los Angeles, LOWDR serves clients across all of California.

Our legal expertise is unique because we routinely advocate matters that span both the public and private sectors, allowing our team to draw upon a vast knowledge base to serve the needs of our clients. The firm’s principal attorney, William D. Ross, has over forty years of experience in representing local governmental agencies and property owners.

We pride ourselves on our collaborative and long-lasting relationships. For example, Mr. Ross has served as City Attorney for the City of American Canyon in Napa County since its incorporation in 1992. Additionally, Mr. Ross serves as District Counsel to several fire protection districts state-wide. Examples of such districts are the San Ramon Valley Fire Protection District in Contra Costa County, the Linda Fire Protection District in Yuba County, Salida and West-Stanislaus Fire Protection Districts in Stanislaus County, the Arbuckle-College City Fire Protection District in Colusa County, the Monterey Regional Fire Protection Districts in Monterey County, the American Canyon Fire Protection District in Napa County, and the Southern Inyo Fire Protection District in Inyo County.

Founder and Principle Attorney

Mr. Ross graduated from Stanford University in 1970 with honors and received his law degree from the University of Santa Clara in 1974.

From 1976-1981, he acted as Deputy County Counsel for the County of Los Angeles where he advised and represented the County Regional Planning Commission. For over eight years, he was a member of the Planning Commission in the City of Pasadena, serving as its Chairman for two years where he participated in the California Institute of Technology Master Plan and the Civic Center Master Plan, a portion of the City’s General Plan.

He has served on numerous advisory commissions to the State Legislature, including the Advisory Committee to the Senate Local Government Committee on revisions to the Subdivision Map Act. Mr. Ross is a member of the Local Government and Administrative Law Sections to the Los Angeles County Bar and the Administrative Law Section of the Natural Resources Section of the American Bar Association, and is a member of the Working Section on Public Lands and Land Use Section of the Natural Resources Section of the American Bar Association.

Mr. Ross has had extensive experience with CEQA compliance, including but not limited to, providing testimony as an expert witness concerning land use development and environmental compliance and acting as lead counsel in several published appellate cases concerning related land use and environmental matters. Mr. Ross has produced numerous opinions for government and private industry as to compliance with CEQA. David Schwarz

Senior Associate

David Schwarz focuses on environmental compliance, land use, employment law, municipal law and civil litigation. He received his law degree in 2010 from the Indiana University Maurer School of Law and obtained undergraduate degrees in Business and Economics in 2007 from Indiana University. Mr. Schwarz has been with the firm since 2011.

Mr. Schwarz represents California cities, special districts and public agencies in a range of litigation matters, including CEQA compliance, employment litigation, nuisance abatement, code compliance, and development fee disputes, among others.

In addition to his litigation experience, Mr. Schwarz routinely advises public agencies on matters involving land use, environmental regulations, public records requests, Brown Act compliance, government finance, and employee relations, including wrongful termination, the Firefighter Bill of Rights, and negotiations with labor groups.

Outside of practicing law, Mr. Schwarz serves as an adviser and board member for Schwarz Family Farms, a 4,000 acre family-owned agricultural operation in the Indiana-Ohio-Michigan area.

Kypros Hostetter is Of Counsel with over thirteen years of contractual and litigation experience with a focus on private developers, California fire districts, municipalities, and other special districts. His extensive substantive knowledge and litigation experience includes matters relating to land use, CEQA, NEPA, environmental law, and municipal law.

Mr. Hostetter earned his undergraduate degree in 1999 from the University of California, Davis, with Highest Honors in History and Classics. He received his law degree from the UCLA School of Law School in 2003, where he served as Chief Managing Editor of the UCLA Journal of International Law & Foreign Affairs. Prior to attending law school, he worked for the California Air Resources Board.

Joining the firm in 2003, Mr. Hostetter advises and represents developers and public entities in matters before administrative agencies. His extensive civil litigation and motion practice includes serving as co-counsel in several published Court of Appeal opinions. Mr. Hostetter also advises public entities on matters involving land use, CEQA, LAFCO, local ordinances, environmental regulations, public records requests, Brown Act compliance, government finance, code enforcement, government contracts, and water law.

CEQA – The California Environmental Quality Act

Clean Water Act, and related Environmental Protection Laws

Our attorneys continually advise its private sector and municipal clients on matters involving environmental compliance. The firm is equipped to assist with the entire environmental review process for both large-scale and small-scale development, including the preparation of an Initial Study, Negative Declaration, or Environmental Impact Report. Our team is experienced in defending against litigation brought pursuant to CEQA and other environmental laws, including representing clients in matters involving the California Porter-Cologne Water Quality Act and the federal Clean Water Act.

LOWDR has recently represented a municipal client in federal court in an action brought under the Clean Water Act regarding allegations relating to a municipal wastewater collection system. Additionally, our team has defended clients in environmental litigation regarding alleged soil contamination brought pursuant to the Comprehensive Environmental Response, Compensation, and Liability Act.

Contracts and Public Bidding Requirements

The Firm consistently prepares and negotiates contracts, including real estate agreements, purchase agreements, service contracts, and construction contracts, among many others. Our experts are knowledgeable of public bidding requirements, including requirements for public works contracts, design-build contracts, and construction manager at risk contracts.

We also prepare the purchasing/public bidding policies for nearly all of our governmental clients, and routinely advise them on matters involving the construction of public works.  For example, our Firm has recently advised a municipal client on the procedures for contracting to replace subterranean water mains, and is representing several fire protection districts on matters relating to the construction of new fire stations and firefighter training facilities.

Employment, Personnel, and Worker’s Compensation Law

LOWDR routinely formulates memorandums of understanding with labor groups and provides representation in employee compensation issues, CalPERS matters, employee lawsuits, Family Medical Leave Act and workplace safety issues, and all forms of personnel discipline and administration. Our firm also has experience in worker’s compensation issues, including self-insurance retention authorities, such as FASIS, and worker’s compensation administrators.  We also advise and represent clients regarding compliance with the Health Insurance Portability and Accountability Act.

Water Rights

Our practice includes advising public agencies, water providers, and developers on water rights and regulatory compliance, including matters involving Regional and State Water Quality Control Boards. We also negotiate, draft, and interpret water supply contracts between governmental agencies.

Legislative and Administrative Compliance

Advocating for and advising our public agency clients on matters involving regulatory and administrative compliance is a key element of our practice. Recently, for example, this has involved compliance with the Governor’s Executive Orders regarding the ongoing drought conditions, as well as emergency regulations issued by the California Water Resources Control Board.

Litigation and Conflict Resolution

LOWDR’s legal experts are well-versed in managing all aspects of a lawsuit, including conducting discovery, preparing and filing legal motions and briefs, attending trial, and mediation of disputes. We zealously advocate our clients’ rights in all state and federal courts across California.
